Idaho Congressman Mike Simpson has announced his support for H.R. 1526, known as the No Rogue Rulings Act (NORRA). The bill aims to limit the authority of district judges in issuing nationwide injunctions. Congressman Darrell Issa of California spearheaded this legislation.
"Elected officials have the power to legislate, not judges with overreaching agendas,” stated Rep. Simpson. He added, "Legislating from the bench and judge shopping have weaponized our judicial system, and limiting the power of district judges to impose nationwide injunctions is a common-sense solution to combat this problem. The United States Constitution gives Congress the authority to regulate the jurisdiction of lower federal courts. This legislation is a critical step forward in returning district courts to their appropriate roles and restoring constitutional balance within our judicial system."
The No Rogue Rulings Act seeks to ensure that district courts focus on resolving specific disputes between the parties involved without extending the scope of their injunctions. Concerns have been raised over district judges increasingly issuing nationwide injunctions that halt executive orders and policies beyond the cases they are directly handling. Statistics reveal that 67% of federal injunctions in the last century targeted actions by President Trump, with 92% of those being from judges appointed by Democrats.
The bill was passed in the House with a narrow vote of 219-213.
