Crapo, Risch, Hagerty Introduce Resolution to Block Biden Admin Rule Restricting Americans’ Second Amendment Rights

U.S. Senators Mike Crapo, Jim Risch, and Bill Hagerty have announced their plans to file a Congressional Review Act Resolution of Disapproval to block the Department of Commerce’s Bureau of Industry and Security interim final rule, which restricts Americans' Second Amendment rights. Senator Crapo stated, “The Biden Administration continues to seek underhanded methods of advancing its anti-gun agenda.” Senator Risch added, “The Biden administration will use every method available to restrict Americans’ ability to lawfully purchase or sell firearms.” Senator Hagerty emphasized that the rule will harm Tennessee manufacturers and destroy U.S. jobs and small businesses in the firearm and ammunition industry.

The interim final rule severely limits American firearm, ammunition, and related-component manufacturers' ability to obtain a license to export their products for sale, effectively extending the current "pause" on export licenses and rescinding approximately 2,000 active export licenses for certain firearms. This move is viewed as an unlawful and unjustified exercise of regulatory authority that will have a significant negative impact on American manufacturers, their suppliers, and the jobs they support.

Senator Hagerty likened the rule to "Operation Choke Point," a politically motivated effort that damages Tennessee manufacturers and subsequently destroys U.S. jobs and small businesses supporting the firearm and ammunition industry. He criticized the Biden Administration's goal of damaging the firearm industry that enables Americans to exercise their constitutional freedom, stating, "Killing American exports is just a means to stifle the legislative process and damage yet another Biden-disfavored industry." Senator Hagerty expressed his satisfaction in leading the effort to overturn the "unlawful and unwarranted rule" to protect American enterprise.

Several other senators, including Marsha Blackburn, Shelly Moore Capito, Tom Cotton, Kevin Cramer, Steve Daines, Deb Fisher, and Cynthia Lummis, are joining Crapo, Risch, and Hagerty in introducing the resolution of disapproval.
